Setako, Ephrem

Ephrem Setako was a senior officer in the Rwandan Armed Forces and Director of the Judicial Affairs Division of the Rwandan Ministry of Defence during the Rwandan genocide in 1994.

Lieutenant-Colonel Setako is alleged to be one of the principal planners and executors of the genocide. He is alleged to have planned, instigated, ordered and participated in killing of Tutsi civilians in Ruhengeri and Kigali-ville prefectures by means of a joint criminal enterprise. He is also alleged to have distributed arms to the Rwanda Armed Forces, the militias and other soldiers engaged in the killings.

Ephrem Setako is charged with six counts of genocide, complicity in genocide, crimes against humanity (murder and extermination), and violations of Article 3 common to the Geneva Conventions. He was arrested on 25 February 2004 in The Netherlands and transferred to the ICTR on 17 November 2004. He pleaded not guilty to all counts.

His trial began on 25 August 2008 before Trial Chamber I of the ICTR and was completed on 26 June 2009.

On 25 February 2010 the International Criminal Tribunal for Rwanda (ICTR) sentenced Ephrem Setako to 25 years’ imprisonment for genocide, crimes against humanity and murder.
