Muvunyi, Tharcisse

Tharcisse MuvunyiTharcisse Muvunyi was the most senior military officer in the Butare Préfecture and Commander of the École des sous-officiers (ESO) in Butare, Rwanda, from April to June 1994. During this period, the Prosecution alleged that Tharcisse Muvunyi, in the company of other local authority figures, went to various communes all over Butare Préfecture to incite the local population to perpetrate massacres against the Tutsi. Muvunyi was accused of having participated directly in the provision of weapons such as grenades to the militiamen and ordered all the ESO officer corps to carry out massacres.

 

On 12 September 2006, the Trial Chamber of the ICTR found Tharcisse Muvunyi guilty of genocide, direct and public incitation to commit genocide and inhumane acts as a crime against humanity and sentenced him to 25 years’ imprisonment.


In an unprecedented move, on 29 August 2008 the Appeals Chamber quashed the conviction of the accused and ordered a partial re-trial. The re-trial, with Muvunyi solely charged with direct and public incitement to commit genocide, began on 17 June 2009.

 

On 11 February 2010 Trial Chamber III found Tharcisse Muvunyi guilty of direct and public incitement to commit genocide after his retrial and sentenced him to 15 years’ imprisonment.
