Rasim DelicRasim Delić was Commander of the Main Staff of the Army of Bosnia-Herzegovina (ABiH) between 8 June 1993 and 1 September 2000. He was charged on the basis of his superior criminal responsibility with four counts of violations of the laws or customs of war for murder, cruel treatment, and rape. These crimes were all allegedly committed in central BiH. The indictment states that Delić, as Commander of the Main Staff, exercised military command and control of the ABiH throughout the country. The indictment thus alleged that by holding this position, Delić was criminally responsible for the acts or omissions of his subordinates.

On 3 March 2005, during his initial appearance he pleaded not guilty to all charges. He was granted provisional release on 6 May 2005 to Bosnia and Herzegovina until the beginning of the trial phase of the proceedings. The trial of Rasim Delić before the ICTY began on 9 July 2007.

On 15 September 2008, the Trial Chamber convicted Delić of Cruel Treatment (as a violation of the laws or customs of war) for crimes committed by the El Mujahed Detachment of the ABiH against captive Bosnian Serb soldiers in July and August 1995, in particular for failure to prevent or punish the cruel treatment of twelve captured Serb soldiers (Chetniks) in the village of Livade and in the Kamenica camp. The Trial Chamber sentenced Delić to three years' imprisonment. He was acquitted of all other charges.

On 11 May 2009, Rasim Delić was granted provisional release pending the hearing of his appeal. The appeal hearing was held on 19 January 2010.

On 16 April 2010 Rasim Delić died in Sarajevo. He was 61.

On 29 June 2010 the ICTY Appeals Chamber decided to conclude the appellate proceedings against Rasim Delić. The Appeals Chamber denied a motion by Delić’s son to continue the proceedings, due to want of standing. In a separate decision, the Court held that the appeal proceedings are finished and that the Trial Judgment can be considered final.
