Request for interpretation of the Judgment of 15 June 1962 in the case concerning the Temple of Preah Vihear (Cambodia v. Thailand)

On 28 April 2011, the Kingdom of Cambodia filed an Application requesting interpretation of the Judgment rendered on 15 June 1962  by the International Court of Justice (ICJ) in the case concerning the Temple of Preah Vihear. The filing of such an application gives rise to the opening of a new case. Together with that Application, Cambodia submitted an urgent request for provisional measures.

In the case of 1962 the Court assigned the Temple of Preah Vihar to the Kingdom of Cambodia, but the temple continued to be a strong issue for both Cambodia and Thailand. Moreover, the ongoing conflict between Cambodia and Thailand over the site has led to periodic outbreaks of violence.

The Kingdom of Cambodia included in its application a list of provisional measures to be enforced on Thailand. These measures include an immediate and unconditional withdrawal of all Thai forces from those parts of Cambodian territory situated in the contested area, a ban on all military activity by Thailand in the area, and for Thailand to refrain from any act or action which could aggravate the dispute.

Public hearings conerning  the request for provisional measures took place on 30 and 31 May 2011. The Court yet to indicate when it will decide whether or not to examine and interpret the 1962 judgment, saying only that the date “will be determined in due course.”
