Certain Activities carried out by Nicaragua in the Border Area (Costa Rica v. Nicaragua)

On 19 November 2010 the Republic of Costarica instituted proceedings against the Republic of Nicaragua with regard to an alleged incursion into, occupation and use of Costa Rican territory by Nicaragua’s Army, as well as breaches of Nicaragua’s obligations towards Costa Rica under a number of international treaties and conventions. Costa Rica charges Nicaragua with having occupied, in two separate incidents, the territory of Costa Rica, in connection with the construction of a canal across its territory from the San Juan River to Laguna los Portillos (also known as Harbor Head Lagoon), and certain related works of dredging on the San Juan River. Costa Rica states that the ongoing and planned dredging and canal construction will seriously affect the flow of water to the Colorado River of Costa Rica, and will cause further damage to Costa Rican territory, including the wetlands and national wildlife protected areas located in the region. The Republic of Costa Rica included in its application a list of provisional measures in order to preserve Costa Rica’s rights of sovereignty and non interference.

Costa Rica also indicated in its Request that the protection of its rights was of real urgency, as the ongoing presence of Nicaragua’s armed forces on Costa Rica’s territory contributes to a political situation of extreme hostility and tension.
On 8 March 2011 the Court delivered its order on Costa Rica’s request for provisional measures. The Court decided that each party shall refrain from sending to, or maintaining in the disputed territory any personnel, whether civilian, police or security, that Costa Rica may dispatch civilian personnel charged with the protection of the environment to the disputed territory and that each party shall refrain from any action which might aggravate or extend the dispute before the Court or make it more difficult to resolve.

On 5 April 2011 the Court fixed the time limits for the filing of the initial pleadings setting the deadlines as 5 December 2011 for Costa Rica and 6 August 2012 for Nicaragua.
